Acceptance
By accessing or using Kinesia ("the Service") at https://kinesia.ai or via our mobile clients, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
What Kinesia is — and is not
Kinesia is a clinical reasoning aid for licensed Physical Therapists. It surfaces evidence and structured reasoning grounded in published guidelines, systematic reviews, and clinical trials.
Kinesia is NOT a diagnostic device, not a substitute for clinical judgment, and not a replacement for the patient–clinician relationship. Clinicians remain solely responsible for clinical decisions made about their patients.
Eligibility
You must be a licensed Physical Therapist (or PT student under supervision), or a member of a clinic or organization that holds a Kinesia subscription. You may not use the Service if you are barred from doing so under applicable law.
Acceptable use
Use the Service only for lawful clinical purposes consistent with your scope of practice and the organization's policies.
Do not enter identifiable patient information (PHI) into prompts unless your organization has a Business Associate Agreement (BAA) in place with Kinesia.
Do not attempt to reverse-engineer, scrape, replicate, or compete with the Service. Do not abuse rate limits.
You are responsible for the security of your account credentials.
Intellectual property
Kinesia and its content are owned by Kinesia and its licensors. You receive a non-exclusive, non-transferable license to use the Service during your subscription period.
You retain ownership of the prompts you submit. You grant Kinesia a license to process prompts to operate the Service and improve quality, subject to the Privacy Policy.
Disclaimers
The Service is provided "as is" and "as available." Kinesia disclaims all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Clinical answers may contain errors, omissions, or outdated information. Always verify against primary sources before applying to patient care.
Limitation of liability
To the maximum extent permitted by law, Kinesia and its operators are not liable for any indirect, incidental, consequential, special, or exemplary damages, or for lost profits, revenue, data, or goodwill.
Aggregate liability is limited to the amounts paid by you (or your organization) for the Service in the 12 months preceding the claim, or USD $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless Kinesia from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any third party right or applicable law.
Termination
Either party may terminate at any time. Termination ends your right to access the Service. Sections that by their nature should survive termination (IP, disclaimers, liability, indemnification) survive.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Disputes are resolved in the state or federal courts located in San Francisco County.
Changes
We may update these Terms. Material changes will be posted to this page with an updated effective date. Continued use after changes means you accept the revised Terms.
